I have to hand it to Ben Fredrickson. That guy is on this story like a bum on a hoagie.

For those who dont have Twitter, I will try and update here what is going down. He is in the courtroom.

6-2-502.� Aggravated assault and battery; penalty.
(a)� A person is guilty of aggravated assault and battery if he:

(i)� Causes or attempts to cause serious bodily injury to another intentionally, knowingly or recklessly under circumstances manifesting extreme indifference to the value of human life;

(ii)� Attempts to cause, or intentionally or knowingly causes bodily injury to another with a deadly weapon;
(iii)� Threatens to use a drawn deadly weapon on another unless reasonably necessary in defense of his person, property or abode or to prevent serious bodily injury to another; or
(iv)� Intentionally, knowingly or recklessly causes bodily injury to a woman whom he knows is pregnant.
(b)� Aggravated assault and battery is a felony punishable by imprisonment for not more than ten (10) years.



Ben said he is released on 25k Bond. Prelim hearing set for Jan 28


Sports aside, I hope he can recover as a person. Stupid actions.

Affidavit says that Derek Cooke and Nathan Sobey were also at the scene.

Ben says: arraignment over, charged with section "i" of aggravated assault and battery statute, prelim hearing set for Jan 28, Derek and Nathan were there as well, he has to check in with the athletic department 3 times per week. that's all twitter says: more to follow I'm sure, released on $25k signature bond as well

A witness said that Derek Cooke knocked out the victim with a punch, then Martinez kicked the victim in the head "like it was a football"

...and that's why charges were filed. They're both idiots, but Luke just ruined his career in a split second.

Affidavit confirms he broke it in a fight, but didn't say how.

A second witness said Martinez took "a running start" and kicked unconscious victim in head. Victim was "laying down in street."

Victim's brother said victim suffered "multiple fractures of lower mandible" as result of fight. Had jaw wired shut. #gowyo

This gets VERY interesting. I am not condoning Luke's behavior; But sounds like the BROTHER is the witness. hmmmm....

Either way, Luke's career is over at UW. Cooke and Sobey need a swift kick in the @ss as well.

Had Luke punched the guy and a fight spilled over outside, then this would have went away. The kicking an unconscious guy while down.....stupid, stupid, stupid.

Martinez probably ruined his basketball career, and his chances of graduating from UW.. not sure they'll keep him in school after this.

That same witness said the victim was KO'd by Cooke punch. Said Martinez then ran and kicked victim in head 15-20 seconds after. #gowyo
