Carbon County Corner Crossing Case

Anyone else been following this? This case is going to be a BIG DEAL all around the country. Rich landowners are buying up all of the land they can around public land and claiming it as their own. They're bitching because people are using ladders to go over the land markers where the sections come together to get from one piece of public land to another. The landowner is crying because they trespassed by occupying the air over the private land.

I guaran-damn-tee that this case will end up in federal court. It's going to set a precedent around the country on how to handle these cases. Check out the video below. Notice at 10:02 when the ranch hand asks, "Do they know how much money my boss has?" Absolutely disgusting.

Congratulations. This is the first time you two have ever been on the right side of an issue. I've listened to many people discuss this case and it appears that if the hunters win and it gets dismissed, nothing happens. It won't set any real precedent. We actually need them to lose initially so it can be litigated to the Wyoming Supreme Court where they will set the precedent. I imagine the minute this happens, the legislature will codify corner crossing as illegal because our legislature as never been a group to listen to the people. It took long sustained pressure to get a lottery. It's possible a group like the TRCP could get something inserted into a federal bill (most corner to corner is federal to federal but I imagine some federal corners with State) but who knows how that route would work. There's lots of public access initiatives out there but this would be the single biggest way to improve public access to public land. I don't even think you should need a ladder. Stepping over a infinitely thin corner of private property does not infringe on property rights imo. The same way we wouldn't prosecute someone waving their arm over my yard as they walk down the sidewalk is the same way we should address this issue. I get it, no one should be able to fly a drone 10 feet above me while I'm in my back yard. There should be a way to allow this and protect private air space

A civil suit was filed. I want to know how taking a ladder from one piece of public land to another someone violated his private property rights.

No joke. I also don't understand how they think their case from the 2020 crossing is going to be any different. It sounds like there weren't T-posts chained together over the survey marker in 2020, so all the hunters had to do was step over it. Your "swinging your arm over someone's lawn" analogy is spot on. There's no way in hell this is trespassing in any sense of the law.
